Terms and Conditions

Fees:1.) Initial Rental Deposit / Security Authorization: An Initial Rental Deposit of $569.00 is due immediately (certain homes and dates may require more) and payable online to secure your desired rental dates. A reservation confirmation will be issued to you upon receipt of your Initial Rental Deposit. We will keep your credit card information on file as a Security Authorization. If everything is left as you found it and no damages have been incurred that is not covered by your rental insurance, your credit card will not be charged anything additional. You will be charged for extraordinary cleaning and laundry, telephone charges, pet damage, dirty dishes not loaded into dishwasher, refrigerator or freezer not empty or excessively dirty, garbage not disposed of properly in outdoor container and furniture not left in the original location. You have purchased rental insurance for $69 nonrefundable in lieu of the $500 security deposit, there will be no refunds and if any violations, a claim will be filed.

2.) Rates & Payment Schedules: Published rates are subject to change without notice.
Payment must be received in full within sixty days (60) of arrival and payable by Personal or Certified check, or major credit card. Required Fees include: (The Weekly Rental fee, cleaning fee, $50.00 Booking Fee, 7.5% State sales tax and 5% County tourist tax [total of 12.5% tax], and other additional fees some properties may incur such as pet deposit and grocery package). If the remainder of the amount due is not received by the 60th day prior to check-in, your $569.00 deposit will be forfeited, and the reserved unit will become available for rentals. No refund for shortened stays.

For rentals commencing less than sixty (60) days from reservation confirmation date, Full payment is due at time of booking.

Same day rentals are accepted based on that days current available rental inventory.

3.) Cleaning: A cleaning fee is charged with your rent payment. Cleaners DO NOT wash dishes or pick up trash around the house. Please leave the house neat and orderly. There will be a charge of $20.00 per hour for any excessive laundry or cleaning. If you arrive early and the housekeeper is still cleaning the unit, you are not to enter the premises or place any personal belongings inside the unit until housekeeper is finished.

4.) Booking Fee: A 50.00 fee is charged with your rent payment to cover some administrative costs and to provide the following starter kit: (toilet paper, paper towels, bar soap, dishwashing detergent and laundry detergent).

5.) Pets: A non-refundable $200.00 charge per pet deposit may apply to a limited number of units that allow pets. Requests for pet allowances need to be made at the time of the reservation. There are no guarantees of availability. There is a maximum weight and number of pets per reservation. Prior to approval, you are required to provide your pet’s medical record. Bringing pets to a non-allowed rental unit will cause immediate eviction from the premises with forfeiture of ALL funds.

In consideration of other guests, please have your pet on a leash while on the property. It is the law!

If your pet is noisy when left alone, please take it with you when going out. There are noise ordinances and fines for this.

If your pet is destructive, please crate when leaving alone as you are responsible for any damages that may result from separation anxiety and these charges will be placed on your credit card.

If your pet is disruptive to other guests (barks in your unit and results in a complaint to our office), you will be asked to board him/her during your stay or you will be asked to leave, with no refund.

You will also be charged for any extra cleaning of your unit upon departure if your pet leaves evidence of misbehavior on furniture or rugs. It is our hope that you and your pet have a wonderful time!

6.) Groceries: For a $50.00 charge we can have food, drinks and other items in your unit for your arrival. Include an extra $150.00 to your final payment, and we will shop your grocery list up to $100.00, providing the receipt and change. You can either email or fax us a list with specifics. Guests may shop on line @ the local Publix grocery store by clicking here to make a grocery wish list and email it to [email protected]

Please email list at least 48 hrs. prior to arrival. Before your arrival the items will be purchased and delivered to the rental unit. The local info for Publix is 5407 Overseas Hwy, Marathon, FL 33050-2710; Main: (305) 289-2920; Pharmacy: (305) 289-3192.

7.) Returned Checks: A $75.00 check fee will be charged if a check is returned to us by the bank for insufficient funds.

8.) Maid Service: For a custom fee per house, you may request extra housekeeping services during your stay.

9.) Smoking: A $250.00 additional cleaning / De-Odorizing fee will be charged for smoking inside one of our units and will cause immediate eviction from the premises with forfeiture of ALL funds. We offer a smoke free environment. Smoking is allowed outside only.

Terms:
10.) Check In: Please print your confirmation letter and map and bring them with you. Units will be ready for check in at 3 p.m. During times of high occupancy, there is no guaranteed check in time. Upon arrival, please get keys as instructed in your letter. Upon your arrival you may find the property has been listed for sale. Therefore, Florida Keys Vacations, Inc. reserves the right to allow a real estate agent to show this property to perspective purchasers. The tenant agrees to make the property accessible with a one (1) hour notice. All of our homes are fully furnished with linens, house wares, cooking utensils and initial consumables provided. A guest signing the rental agreement assumes all responsibility for the actions and behavior of all guests and agrees to follow the rules of the property posted therein. Our properties are in residential neighborhoods and are unsuitable for loud parties, events or entertaining groups. If behavior or noise results in a noise complaint or any violation set forth by the City of Key Colony Beach or City of Marathon laws and ordinances, or any other violation of the rental agreement, you will be asked to leave with no refunds given.

11.) Keys: Keys will be issued at check-in as instructed. At check-out all keys must be returned to same place you received them. If guests lock themselves out of their unit and the office staff is called to open the unit, a $100.00 charge will be imposed. If keys are lost, there will be a $50.00 charge for each key. This will be charged to your credit card on file.

12.) Late Arrivals: Please advise us of your arrival time and we will have keys in the lock box located close to the rental unit’s door. For the code to the late night lock box call the 24-hour office hotline 305-304-3830 and you will be connected to a person who will give you the code if you did not receive it prior to arrival. Rent must be paid in full prior to arrival.

13.) Check Out: At Florida Keys Vacations, Inc. a representative will arrive at 10 am for a walk-thru on the day of your departure. Special arrangements must be made in advance if you need a later checkout time; otherwise you will be charged $200.00 to your credit card on file for cleaning rescheduling purposes. There may be someone checking in. All furniture, fixtures and personal property should be returned to its original positioning, dishes washed and trash taken out prior to your departure or an additional charge will be assessed. Please secure the property and place keys in lockbox. If personal property is left behind and it is necessary for the items to be returned, a $25.00 fee, in addition to the cost of the postage and containers, will be assessed.

14.) Cancellation: The initial deposit will be refunded, less a $50.00 cancellation fee if you cancel at least sixty (60) days prior to your arrival. Reservations cancelled with less than sixty (60) days’ notice will not be refunded. If you are concerned about potential health issues or illnesses in your family, please purchase Travel Insurance.

15.) Hurricane Cancellation Policy: Effective June 1 to Nov. 30: Tenants agree to vacate the premises when a mandatory evacuation Order has been issued due to a pending hurricane. We do not refund for weather or other circumstances beyond our control. We strongly encourage the purchase of Travel Insurance to protect your vacation investment! In the unlikely event that a hurricane evacuation is ordered while you are a guest, and you have not purchased travel insurance, you will be issued a credit refund for any unused portion of your stay. Guests holding a confirmed reservation, who are unable to travel because of the closing of the local Airports or connecting roadways due to a mandatory evacuation and have not purchased travel insurance, will receive a refund for any unused portion. No refunds will be issued if the hurricane is not a threat to the Florida Keys and you are unable to travel because of canceled flights or adverse travel conditions outside the Keys. We strongly encourage the purchase of Travel Insurance to protect your vacation investment!

16.) Travel Insurance: Please note that we are an agent ONLY for CSA Travel Insurance and it may be added to your reservation and payment. We provide a link on this website to help answer questions prior to booking and purchase of insurance(s). Their comprehensive travel insurance benefits include trip cancellation, interruption, travel delay, lost baggage, worldwide health & medical coverage, emergency medical evacuation (hospital of choice), hurricane protection, terrorism and more.

17.) Occupancy: The rental agreement specifies the number of adults and children allowed to stay as guests in the unit. Each house has its own limit of tenants allowed. One (1) person permitted per 200 sq. Ft. or less depending on the owner. EXCEEDING your limit will cause immediate eviction from the premises with forfeiture of ALL funds. We will be happy to accommodate you with two (2) or more houses to fit your vacation needs.

18.) Minimum Stay Requirements: Most Marathon and Key Colony Beach vacation rentals are a minimum of a (1) week stay. There are areas of Monroe County which have a minimum of 28 days.

19.) Special Events/Holidays: Different rates may apply to the following holidays: Memorial Day, Independence Day, Mini Lobster Season, and opening week of Lobster Season, Labor Day, Fantasy Fest, Parrot heads, Thanksgiving, Christmas, and New Years.

20.) SPRING BREAKERS: Spring breakers are not allowed in any of our properties. Occupants under the age of twenty-five (25) must be accompanied by a parent, guardian or a family group. If it is discovered that occupants are under the age of twenty-five (25) and not accompanied by any of the above, will cause immediate eviction from the premises with forfeiture of ALL funds.

21.) Concierge: Our office staff is always available to answer any questions. We will also be happy to give you recommendations for restaurants and other activities on our islands.

22.) Parking / Dockage: Guests need to be aware that parking is limited to the designated number of vehicles listed per unit. No campers or RV’s are allowed on the property at any time. Do not park your vehicles or trailers on any other property. Please be considerate of your neighbors parking and dockage space. Key Colony Beach Rentals: Only one (1) boat and one (1) trailer allowed on property. If you arrive on the weekend or holiday, you can park your trailer between 7th & 8th streets trailer parking lot. Please check with Key Colony Beach City Hall @ 305-289-1212 ext.0. You MUST register your trailer before noon on Monday @ City Hall. Each house has room for two (2) vehicles to park on the property. All vehicles must be 25 ft. away from center line of road.

24.) Trash: Garbage on Key Colony Beach is picked up on Saturday & Tuesday mornings. Trash cans may be put curbside the day before after 12:00 pm and must be taken back to side of homes by midnight 6:00 pm on the day of pick up. Yard waste is on Wednesday and recycling is on Tuesday. If trash cans are full you can still put your trash at the curb, as long as it is in plastic trash bags that are tied or sealed. Failure to abide by these rules will result in a $50.00 fine. If you are leaving on Saturday or Sunday trash must be taken to the curb Friday afternoon. Garbage, recycle and yard waste varies on dates in Marathon. Please check your individual house for specifics.

25.) Utilities: Any excessive use will be debited to your credit card on file. Violations of any local water restrictions / ordinances will be charged to your credit card on file. Be sure all faucets, lights, air conditioners, electronics, and appliances are turned off at the time of your departure. Please leave the refrigerator on.

Conditions:
26.) Vacation Rental Indemnification and Hold Harmless Clause: Guest is responsible for and shall indemnify the Owner and Florida Keys Vacations, Inc., upon demand, and hold them harmless from any and all claims, liability, demands, actions, causes of action, expenses, damages, losses, or injuries sustained by any person including Guest, Guest’s family, agents, guests or invitees as a result of or arising from the Guest’s subject occupancy and tenancy, including, but in no way limited to claims arising from the use of any amenity such as kayaks, bicycles, pool, hot tub, spa-pool, water area, or dock which are part of the rental premises. Guest shall also be liable and indemnify the Owner and Florida Keys Vacations, Inc. upon demand for attorney’s fees and court costs incurred by the Owner and Florida Keys Vacations, Inc. in enforcing any of the terms, covenants or conditions of this Rental Agreement or which are sustained by the Owner and Florida Keys Vacations, Inc. as a result of or arising from or during Guest’s subject occupancy and tenancy.

27.) Swimming Pool and Hot Tub Safety: Guest acknowledges and specifically understands that drowning is the leading cause of death of young children in Florida and is also a significant cause of death for medically frail elderly persons. Consequently, Guest agrees, as a material condition of this Lease and as a material inducement to the Owner and/or Florida Keys Vacations, Inc. to enter into this Lease, to constantly supervise, or provide constant adult supervision, when children or medically frail elderly persons use, are near, or have any possible access, intentional or unintentional, to the swimming pool that is part of the rental premises. Guest further acknowledges and understands that the subject swimming pool, hot tub and rental premises contain pool safety features designed to deny, delay or detect unsupervised entry to the swimming pool so as to reduce the risk of drowning or near-drowning incidents. Consequently, Guest agrees, as a specific material condition of this Lease and as a material inducement to the Owner and Florida Keys Vacations, Inc. to enter into this Lease, to use all such safety devices as intended and to advise all family members, guests and invitees of said requirement, including, without limitation, any gate latches, exit alarms if applicable or swimming pool safety covers, if applicable.

28.) Non-Liability For Personal Property: Guest agrees that the Owner and/or Florida Keys Vacations, Inc. shall not be liable for any loss of or damage to any personal property in or on the rental premises or stored in rooms or places provided to Guest in connection therewith, nor shall the Owner and/or Florida Keys Vacations, Inc. be liable to Guest, Guest’s family, guests, or agents for failure to repair or maintain any part of the rental premises or property contained therein, absent gross negligence. Guest further agrees that neither the Owner and/or Florida Keys Vacations, Inc. shall be liable for any damage to the personal property of the Guest, Guest’s family, guests or agents arising from theft, vandalism, fire, water, rain, acts of God or government, interruption of utilities, acts of others or other third party or external causes whatsoever.

29.) Ejectment Policy: Guest acknowledges and agrees that the Owner and Florida Keys Vacations, Inc. may remove or cause to be removed from the rental premises any Guest or occupant who, while at the rental premises, illegally possess or deals in controlled substances, violates any of the terms of this rental agreement, is intoxicated, profane, lewd, or brawling, who indulges in any language or conduct which disturbs the peace and comfort of other guests or neighbors, or which constitutes a nuisance, or which injures the reputation, dignity or standing of the rental premises, or anyone who fails to make a payment of rent at the agreed-upon time unless an extension of time is expressly agreed to by the Owner and Florida Keys Vacations, Inc. and the Guest prior to check-out. Admission to and removal from the rental premises is not and shall not be based upon race, creed, color, sex, physical disability or national origin. Any notice to vacate may be given orally or in writing by the Owner and Florida Keys Vacations, Inc. to Guest or Occupant, and if in writing shall be as follows: “You are hereby notified that this establishment no longer desires to entertain you as its guest, and you are requested to leave at once. To remain after receipt of this notice is a misdemeanor under the laws of this state.” If any Guest who is asked to vacate early has paid in advance, Florida Keys Vacations, Inc. shall, at the time notice is given, tender to the Guest the unused portion of the advance rent and fees payment without pro-ration for any portion of the day that Guest is noticed to vacate. The Owner and Florida Keys Vacations, Inc. may file claim to rental insurance without further notice as agreed upon liquidated damages, consideration for the execution of this Rental Agreement and in full settlement of all claims, or the Owner and Florida Keys Vacations, Inc., may proceed at law with any damages claim. Any Guest who remains or attempts to remain in the rental premises after being requested to vacate shall be guilty of a misdemeanor of the second degree punishable in accordance with Florida law. If any person is illegally at the subject rental premises, the Owner and Florida Keys Vacations, Inc. may call upon any law enforcement officer of this state for assistance. If the Guest is arrested, the Owner and Florida Keys Vacations, Inc. shall employ all reasonable and proper means to care for any personal property which may be left at the rental premises by the guest; however, upon arrest, the Guest/guest shall be deemed to have given up any right of occupancy and to have abandoned such rights.

30.) Substitute Accommodations: Florida Keys Vacations, Inc. will make all reasonable efforts to have the rental premises available for Guest’s rental term and reserves the right to substitute comparable accommodations should your confirmed unit become unavailable due to unforeseen circumstances such as but not limited to; natural disaster, fire, or other casualty or due to sale and transfer of ownership of the rental property to another party. However, Florida Keys Rentals, Inc. cannot guarantee the rental rate. Florida Keys Vacations, Inc. will offer a substitute property to guest for approval. The tenant reserves the right to accept or refuse the substitute accommodations and rental rate. If guest rejects the substitute property, then all collected deposits and fees will be immediately returned to tenant, and the Owner and/or Florida Keys Vacations, Inc. shall have no further liability or responsibility to Guest. All terms and conditions of this Rental Agreement shall apply to any acceptable substitute rental premises. Florida Keys Vacations, Inc. is permitted, at any reasonable time, to enter any part of the premises for the purpose of inspection or repairs.
